In no event shall the County of Westchester be liable to any person or entity named in any record that any person or entity files, attempts to file, and/or fails to file in the Office of the County Clerk, or for the loss of any interest of any kind, or loss or corruption of data, resulting from or by reason of (1) the unavailability of the PREP system at any time, or from time to time, without regard to whether such unavailability is due to mechanical, electronic or communications failure, or scheduled or unscheduled maintenance or testing, or any other cause; or (2) the inability of any system, equipment or software to transmit all or any part of the record within the PREP system; or (3) any failure to file, or any delay in filing, all or any part of any record to the Office of the County Clerk’s office; or (4) any inaccuracy in which all or any part of any records is filed with the Office of the County Clerk; or any other matter related to any use or attempted use of the PREP System.

The Westchester County Clerk may from time to time announce a schedule of the days and times during which the PREP System will be available, however any such schedule will be subject to outages due to repairs, maintenance, emergencies, etc.

When a person or entity submits a document with the Office of the Westchester County Clerk, said documents are accepted for filing only after (1) proper payment is received; and (2) documents are determined to be readable; and documents are presented in recordable form under the applicable laws.
